Terms & Conditions

These Terms & Conditions ("Terms") govern the sale of artworks and prints through leidari-dey.art (the "Site"), operated by:
- Elena Badasen, trading as "Leidari Dey"
- Legal status: individual entrepreneur ("trabalhador independente")
- Registered address: Rua 3, 220, 2 direito, 4500-298 Espinho, Portugal
- Tax identification number (NIF): 314608095

- References to "we", "us", "I" mean Elena Badasen / Leidari Dey; "you" means the buyer.
2. Products and prices
All artworks, prints, and related items offered on the Site are described as accurately as possible; colours may vary slightly depending on your screen.
Prices shown are in EUR and, where stated, include VAT for EU buyers. Shipping costs are quoted separately as described in the Payment & Shipping Policy.
If a discount or sale price is advertised, the reference price shown will be the lowest price applied in the 30 days before the discount, in line with EU price-transparency rules.
3. How a contract is formed
The Site does not have an automated checkout. To purchase an item, you contact the seller (by email or direct message on the linked social platforms) referencing the item you wish to buy.
A contract of sale is concluded once the seller confirms availability and price in writing (email/message) and you have paid in accordance with Section 4. This is a distance contract concluded exclusively through means of distance communication (website, email, messaging), and EU consumer-protection rules on distance selling apply to buyers who are consumers residing in the EU.
4. Payment
Accepted payment methods: European IBAN bank transfer or PayPal, as described in the Payment & Shipping Policy.
If you pay via PayPal, you provide your payment details directly to PayPal, which processes that data as an independent controller under its own privacy policy. We only receive the transaction confirmation and the information necessary to fulfil your order (see our Privacy Policy).
The order is processed once payment has cleared.
5. Delivery
Shipping origin, timeframes, and costs are described in the Payment & Shipping Policy.
Risk of loss or damage passes to you once the item is delivered to you or a carrier you designated, as applicable under Portuguese law.
6. Right of withdrawal (EU consumers)
If you are a consumer purchasing from within the EU, you have the right to withdraw from the purchase within 14 days of receiving the item, without giving any reason, as described in our Return Policy.
To exercise this right, tell us clearly that you are withdrawing — for example by writing to leidari.dey.the.artist@gmail.com — before the 14-day period expires. Email is our preferred and fastest channel, but you may use any clear written statement.
Once we receive your withdrawal notice, we will confirm receipt and refund your payment as soon as possible, and in any case no later than 14 days from the day we are informed of your decision. Where the purchase involves a physical item, we may withhold the refund until we have received the item back, or you have supplied evidence of having sent it back, whichever is earlier.
Custom or personalised items are excluded from the right of withdrawal, except where the item arrives damaged or not as described.

7. Legal guarantee of conformity
Independently of the right of withdrawal above, EU consumers benefit from a statutory legal guarantee that goods are delivered in conformity with the contract, for a minimum period as set by Portuguese law implementing Directive (EU) 2019/771 (generally two years from delivery, unless local rules provide for a longer period).
If an item you receive is damaged, defective, or not as described, contact us at leidari.dey.the.artist@gmail.com and we will offer a repair, replacement, price reduction, or refund as required by law.
This legal guarantee is separate from, and in addition to, the voluntary return policy in Section 6.
8. Complaints
If you are unhappy with your order, please contact us first at leidari.dey.the.artist@gmail.com so we can try to resolve it directly.
9. Personal data
Personal data you provide in connection with an order is processed as described in our Privacy Policy.
10. Intellectual property
All artworks, images, and content on the Site remain the intellectual property of Elena Badasen unless explicitly stated otherwise. Purchasing a physical artwork or print does not transfer copyright or reproduction rights unless separately agreed in writing.
11. Geographic availability
The Site is available to buyers throughout the EU without discrimination based on nationality, place of residence, or place of establishment, in accordance with EU Regulation 2018/302 on unjustified geo-blocking.
12. Governing law and jurisdiction
These Terms are governed by Portuguese law.
If you are a consumer habitually resident in another EU member state, you also retain the protection of any mandatory consumer-protection provisions of the law of your country of residence that cannot be excluded by agreement.
Any dispute will be submitted to the competent courts of Portugal, without prejudice to any mandatory right you have to bring proceedings in the courts of your own country of residence as a consumer.
13. Changes to these Terms
We may update these Terms from time to time. The version in force is the one published on the Site at the time of your order.
